As set forth below, goodcause exists in the instant action to deny Defendant’s motion.FactsOn or about July 14, 2009, Plaintiff filed the instant action to foreclosure a mortgage onreal property located in Sarasota County, Florida. Defendant retained counsel who filed aMotion to Dismiss on April 2, 2012. Thereafter Defense counsel filed a Motion to Withdraw andwas allowed to withdraw from representing the Defendant on September 4, 2012. Followingcounsel withdrawing from this action, Plaintiff noticed Defendant’s Motion for hearing onNovember 28, 2012 and sent the Notice to the address as indicated on the Court’s Order.Counsel then filed a subsequent Notice of Appearance on December 18, 2012. As a result,Defendant’s Motion was set for hearing while Defendant did not have an attorney of record. Seethe Docket attached hereto as Exhibit “A.” Notwithstanding the material facts of this case,Defendant though counsel has filed the Motion at issue. Counsel for Defendant has beenFiled for Record 04/12/2013 04:30 PM - Karen E. Rushing, Clerk of the Circuit Court - Sarasota County, FL - 2009 CA 011878 NC Dkt-89562624 Page 1 of 10unresponsive to attempts to narrow or resolve this issue and as such, Court action is required.See Exhibit “B.”ArgumentDefendant’s Motion requests that the Court enter “...a protective order canceling thehearing and awarding Defendant reimbursem*nt of attorneys’ fees for having to file this motion.”See Motion. The hearing at issue was scheduled when the Defendant was a pro se litigant.Further, Defendant’s Motion should be denied as the grounds cited in support thereof are bothmoot and not supported by controlling law.In support of the Motion, Defendant asserts that “[o]n February 11, 2013, Plaintiff set ahearing for Defendant’s motion to dismiss for February 26, 2013 without clearing it with theundersigned counsel.” See Motion, 2. As previously noted, Plaintiffs counsel set this matterfor hearing on November 28, 2013 when the Defendant was not represented by Counsel. SeeExhibit “A.” As a result, the allegation that the hearing was improperly scheduled is meritless. _Further the hearing was immediately canceled upon proper notification from defense counsel thatthey had made a subsequent appearance in the case and had a scheduling conflict with thehearing date. See Exhibit “C.” Thus Defendant suffered no prejudice or harm.In addition, protective orders are governed by Rule 1.280(c) which provides that “[u]ponmotion by a party or by the person from whom discovery is sought, and for good cause shown,the court in which the action is pending may make any order to protect a party or person fromannoyance, embarrassment, oppression, or undue burden or expense.” (emphasis added). Thenotice of hearing at issue does not relate to discovery and as such, the request for relief isinappropriate under the Rules. Further, the hearing has been cancelled and as such, a protectiveBAC v. Rushing, Clerk of the Circuit Court - Sarasota County, FL - 2009 CA 011878 NC Dkt-89562624 Page 2 of 10order is not appropriate nor is it warranted under these facts as this matter has been resolvedwithout court action.Finally and most importantly, Defendant is not entitled to sanctions in any form.Defendant does not cite to any authority in support of the contention that she is entitled to“reimbursem*nt for attorneys’ fees for having to file this motion.” See Motion. The facts donot support finding that Defendant is a prevailing party nor did she demonstrate that Plaintiffasserted unsupported legal or factual claims in this action. Further, Defendant did not complywith F.S. 57.105(4) which provides:A motion by a party seeking sanctions under this section must be served but may not befiled with or presented to the court unless, within 21 days after service of the motion, thechallenged paper, claim, defense, contention, allegation, or denial is not withdrawn orappropriately corrected. (emphasis added)Defendant did not provide the Motion to Plaintiff's counsel within the safe-harbor provision asrequired under F:S. 57,105(4). This pleading defect is fatal to Defendant’s Motion and as such, therequest must be denied.ConclusionThe foregoing discussion demonstrates that the Defendant is not entitled to the reliefsought. The hearing at issue was scheduled while the Defendant was a pro se litigant and wasimmediately counsel upon notification from defense counsel of a scheduling conflict. Further,the request for relief is inappropriate under Rule 1.280(c) as protective orders are in place toprotect litigants against abusive or harassing discovery. Finally, F.S. 57.105 does not support therelief sought and defense counsel did not comply with the safe-harbor provision under F.S.57.105(4) in filing her Motion. For these reasons, Defendant’s Motion must be denied.BAC v.
